Bill to ban texting & driving fails

News reports about a car accident caused by a distracted driver are not uncommon to read. Though many states now have laws banning texting and driving for all drivers, our Arizona residents will find it interesting to learn that currently, Arizona law only bans school bus drivers from using wireless devices when behind the wheel.

In an effort to change the law, State Senator Farley introduced a bill to ban texting and driving for all drivers in Arizona. However, those opposing the bill noted that there are other laws already in place which address the issue of texting and driving.

Although there is currently no Arizona statute on distracted driving, an Arizona Department of Public Safety spokesperson noted that presently, law enforcement use existing laws to prevent distracted driving. The violations used by officers to cite a driver may include unsafe lane changes, not using signals, tailgating, driving too close to the center line and actually colliding with another vehicle.

Although there are many traffic laws in place to penalize those who violate traffic laws, car accidents caused by a distracted driver routinely happen and can result in debilitating and life-long injuries. The negligent driver could be required to pay damages to the injured victim. Damages may include medical expenses, lost wages and pain and suffering.
